Definitions

1. Purple Butterfly Learning would be referred to as “We”, “Us”
2. The client or learner or learner group would be referred to as “They”, “You”
3. The Contract Trainer would be referred to as “Trainer”

General Contract for Services

Purple Butterfly Learning is an organization that promotes and assists learning. The Website and services, all mobile applications owned, operated and distributed are owned by Purple Butterfly Learning. By using our website, services or mobile application you agree to the General Contract for Services, Terms of Service and the Privacy Policy. We at any time may modify these agreements and the latest will be available on our website. By accessing our website you agree to our latest available modifications.

Purple Butterfly learning matches students to the courses available and allows for a learning experience. We reserve the right to refuse providing service to any individual or organization prior to taking the payment for any reason, at any time with or without prior notice.

Intellectual Property Copyright:

All training material, content, trademark, logo and lessons are owned by Purple butterfly learning and any duplication, in order to copy, reproduce, publish or distribute it’s proprietary content would require a license to be purchased.

Accounts:

While creating an account, you agree to the following:

1. You are solely responsible for protecting your username, password and other sensitive information attached to your profile. We will not be responsible or liable for any loss that occurs due to your failure to comply with this.
2. All personal information that you provide must be up to date, accurate and truthful.
3. You must be a human to open an account, ‘bots’ are not permitted.
4. You must be at least 18 to create an account.

Third Party Goods and Services:

Our Website may contain links to third party websites or services which we do not own or control and hence we are not responsible for their content, claims, goods, services, policies or practices. It would be your responsibility to read and comprehend their privacy policy, terms and conditions prior to using their services.

Links to other websites:

Purple Butterfly Learning and its employees, affiliates and subsidiaries will not be responsible for any actions, losses, claims, liabilities and expenses including legal fees from your use of this site.

Limitation of Liability:

Purple Butterfly Learning and its employees, affiliates and subsidiaries will not be responsible for any actions, losses, claims, liabilities and expenses including legal fees from your use of this site.

Indemnity:

Except where prohibited by law, by using this website you indemnify and hold harmless Purple Butterfly Learning and its employees, affiliates and subsidiary from any actions, losses, claims, liabilities and expenses including legal fees from your use of this site or your violation of these Terms and Conditions.

User Mandates:

As a user of the website of any of our services you agree to the following:

1. You would behave in a respectful manner and not engage in any activities, post any content or any other behaviour that would be detrimental or offensive to any other user or Purple Butterfly Learning, its employees, subsidiaries and affiliates. This includes but is not limited to:
1. Use our service or website for any unlawful purpose, or any activity that infringes into the personal space of any other user.
2. You are solely responsible for the content and communication used while using our services or in a public forum.
3. You will upload or use any copyrighted, trademarked intellectual property or proprietary material on our website or during our services.
4. You will be cautious about misrepresenting Purple Butterfly Learning on other public forums.
5. You will not engage in any emails or other modes of communication that amounts to spamming, bulk emails, unsolicited advertisements, chain letters, or any form of gambling or lottery, or any other forms that are offensive to any community or group, or not in tandem with the general decorum.
6. You will not upload, share, post, distribute or partake in any behaviour that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies.
7. You will not partake in any behavior that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
8. You will not share software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party.
9. You will not impersonate any person or entity, including any of our employees or representatives.
10. You will not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Not all parts of the Service may be available to you or other authorized users of the Service. You shall not interfere with anyone else’s use and enjoyment of the Service. Users who violate systems or network security may incur criminal or civil liability.

Applicable Law:

These Terms and Conditions are governed by the laws of the State of Kerala, India.

Changes:

These Terms and Conditions are subject to change any time to comply with the law and reflect our changes in operation. We expect users of our website to behave in a respectful manner. For any update please check our website. We reserve the right to change our fees for the services provided or for any free services currently in use provided that such changes will not apply to fees or charges paid or free services used prior to the time of the change.

Payment Terms:

Purple Butterfly Learning takes payment through PayPal and Stripe or any other service in the future. We expect payment done in full prior to the service. There will be no refunds once the service has commenced. We will provide upto 50% refund if there is a cancellation prior to 48 hours of service. Any refunds processed may deduct the processing fee. All payments will be subject GST as applicable from time to time and details required under GST will be sought to be provided by the payee.

Non-Disclosure Agreement:

Confidential Information means all data and information relating to the business, the services provided and the management of Purple Butterfly Learning including but not limited to the following

1. Customer information, the details provided by other customers or users of the Purple Butterfly Learning services.
2. Service information and all data provided before, during or after rendering our services, amounting to but is not limited to materials given, method of instruction, trainer details, mode of delivery etc.
3. Any Marketing related information it includes but is not limited to vendor names, vendor information, internal costs, internal services, operational manuals, external business contacts including those stored in social media platforms or other similar such platforms, and the operation of the business.
4. Product or Service information provided or shared before, during or after rendering the service. This includes plans, schedules, training material, method of delivery, assessment methods, and trainer details.
5. Account related information, account username, password and other such personal and confidential account details.

The Employee, User, Trainer will not use such information proprietary in manner which is deemed directly or indirectly detrimental to Purple Butterfly Learning.

Any Employee, User, Trainer agrees to be responsible and take necessary action to prevent such occurrences and would indemnify the Purple Butterfly Learning in the event of a breach of this agreement.

Independent Contractor Agreement:

As an independent trainer, you will agree to and abide by the following rules and regulations:

1. You will see the project you have accepted to completion and follow the schedule decided upon, arriving in time and available for classes with complete focus and attention.
2. You will conduct the session without any discrimination or personal biases, against the students.
3. You will not upload, share, post, distribute or partake in any behaviour that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies.
4. Any content you submit or use for training purposes must not contain any third party copyrighted material.
